The Edo State Governorship Election Petitions Tribunal on Tuesday struck out the Peoples Democratic Party as a the second petitioner in the suit filed by its candidate, Charles Airhiavbere against the victory of Governor Adams Oshiomhole in the July 14 governorship poll in the state.

This was sequel to an application filed by Counsel to the PDP, Kingsley Obamogie seeking an order of the court for the name of the second petitioner to be struck out.

The court room was packed full with both supporters of the PDP and the Action Congress of Nigeria.

Efe Akpofure (SAN) led 12 others to argue Airhiavbere’s case, while Ricky Tarfa (SAN) led Akintola Adeniyi, Omonuwa Omoruyi and seven others for Governor Oshiomhole.

Counsels of the 3rd to 5th Respondents were N.H Anita and D.O Owolabi.

Obamogie also filed another application seeking the court order for a change of counsel for the second petitioner.

Before application was presented, Obamogie had interrupted while Akpofure was listing names of the petitioner’s counsels but Akpofure insisted he (Obamogie) remained the second petitioner’s counsel until the court took an order on change of counsel.

Ruling on the application for change of counsel, the three-man panel headed by Justice Suleiman Ambrusa said there was merit in the application and granted the prayers of Obamogie.

On the removal of PDP as the second petitioner, Akpofure insisted that paragraph 5 of affidavit supporting the motion on notice be expunged. Home Page
