Election Petition Tribunal: Wike Appeals Judgement

Governor Nyesom Ezenwo Wike of Rivers state has appealed against the governorship election petition tribunal judgment which annulled his election on October 24.

Wike, who is challenging the entire judgment, filed an appeal at the Appeal court in Abuja asking it to set aside the tribunal’s judgment, Daily Trust reports.

In a notice of appeal dated November 3, and filed by his lawyer, Emmanuel Ukala (SAN), the governor raised 26 grounds of appeal upon which he raised complaint against the tribunal judgment.

In the appeal, which joins Dr Dakuku Peterside, the APC, the Independent National Electoral Commission (INEC) and the PDP as respondents, Wike argued that the findings and conclusion of the tribunal was not supported by evidence before the court.

He added that the tribunal erred in law when it relied on hearsay and inadmissible evidence to nullify his election.

He asked the court to allow the appeal and to make an order setting aside the judgment of the  Rivers state governorship election tribunal.

No date has been fixed for hearing.

The election petition tribunal sitting in Abuja and headed by Justice Suleiman Ambrosa on Saturday, October 24 nullified the April 11, 2015 election that produced Wike as governor of Rivers state, citing irregularities and non-compliance with the provisions of the Electoral Act. The tribunal ordered for a fresh election to be conducted within 90 days.

Speaking on Sunday, October 25, at a thanksgiving service, Wike said he will complete his four year tenure in spite of the ruling of the tribunal.

Meanwhile, the All Progressives Congress (APC) in the state said their gubernatorial candidate, Dakuku Peterside, will mercilessly beat Wike in a free and fair election.
