A Magistrate’s Court sitting in Ebute Meta has remanded nine men accused of masterminding a shoot-out at Ikorodu, Lagos State in prison.
One person was killed, another got missing and many others injured in the incident.
The men were arraigned on a 17-count charge of conspiracy, attempted murder, aiding disappearance and murder.
The two counsel for the defendants filed application for their bail on the first three charges and prayed the judge to strike out the murder charge for lack of evidence.
A mild drama, however, broke out when the application was challenged by the prosecutor, Inspector Nwosu George. He was described by one of the defendant’s lawyers as an ‘educated policeman’ who had no legal right to challenge the application.
The magistrate, Mr. Tunbosun Abolarinwa, who agreed with the lawyer said, ‘’The prosecution cannot cite any section of the law. He cannot also read it to the court.
“Wearing fine suit does not make you a lawyer, if you want to become a lawyer you have to work for it and go to the university.’’
The prosecution acknowledged his limitation and said he was working towards becoming a lawyer.
On the count of conspiracy, Bolarinwa granted bail to the defendants in the sum of N500,000 each, with one surety each, who must either be a blood relation or a community leader .
But he declined to grant them bail on the count of murder pending the advice of the state Director of Public Prosecution
Bolarinwa, who noted the sensitivity of the case because of the death of Jimoh and the disappearance of Dada, commended the prosecution for bringing the case to court on time.
The case was adjourned till April 4.
