Two accused persons were arraigned before Chief Magistrate Gimba Mohammed Gabi for killing their father and his love child an offence punishable under section 221 of the penal code.
Two persons, Ishaku Ahmodu and Mohammed Bala, were remanded in prison for separate cases of culpable homicide in Lapai and Minna Niger state.
The charge said that Ishaku Ahmodu had killed his father in a farm on January 29 this year in Kpade Village of Lapai Local Government Area of the state after an argument.
Similarly Mohammed Bala was said to have killed his father’s three month old love child by one shamsiya Musa in Saiko area of Minna on January 25, this year.
The accused persons pleaded not guilty when the charge was read to them by the trial Chief Magistrate even as the police prosecutor, John Ateni, objected to their bail.
The prosecutor stated that because the offence was not bailable, they should be remanded in prison custody to enable the police conclude its investigation and tidy up the case against them.
The Chief Magistrate ruled that the court would conduct preliminary trial into the case as the court had no Jurisdiction for the final determination of the case but ordered that the accused persons be remanded in prison custody till March 4, 2013, pending the outcome of the advice of the Director of Public Prosecution (DPP).
