A Federal Capital Territory High Court sitting in Maitama has placed a restraining order against the House of Representatives.
The court ordered the House of Representatives to restrain from prosecuting a former secretary to the government of the federation Anyim Pius over alleged fraud in the Centenary City project.
In an ex-parte order, Justice U.A Musale specifically restrained the House of Representatives, its members or security agencies from acting on its committee report which was adopted on March 16.
The court said no further action should be taken on the report pending hearing and the determination of a motion on notice filed before it by Anyim.
Recall that Anyim had in a suit, CV/1303/17, told the court that the House of Representatives and security agencies were planning to use the said report to arrest, detain and file criminal charges against him.
Anyim through his lawyer, Mike Ozekhome sought a court's relief to bar the respondents from directing anybody or security agencies to act on the report.
He also sought a relief of the court to prevent any of the respondents from victimizing him pending determination of his suit.
Anyim said: “Unless the Respondents are restrained as a matter of grave urgency pending the determination of the motion on notice, they shall continue to act on the report, malign and victimize the person of the Applicant notwithstanding the present action which seeks to set aside and nullify the said report."
He added that the first and second respondents in the suit are the House of Representatives and Chairman, House Committee on FCT, Hon. Herman Hembe.
NAIJ.com recalls that the former secretary to the government of the federation is currently being probed for his alleged fraudulent involvement in the Centenary City Project which was initiated by ex-President Goodluck Jonathan’s administration.
